On July 12, 2023, Governor J.B. Pritzker signed HB 2789 into law, creating PA 103-0100. Effective Jan. 1, 2024, this bill ties the receipt of grant funds from the Illinois State Library to a library’s adoption of the American Library Association’s “Library Bill of Rights” or the adoption of a written policy that that library will protect the intellectual freedom of the library user.
PA 103-0100 is being reviewed by the Joint Committee on Administrative Rules. (JCAR) and was published in the Illinois State Register (page 13038) on Sept. 8, 2023. The exact rules from JCAR will not be finalized until the end of the comment period later in October. However, because this ties into grant funding from the Illinois State Library, public libraries submitting a Public Library Per Capita Grant in January of 2024 will be expected to be in compliance.
